Even under the best of circumstances, an employer will be confronted with problematic employee behavior as well as employees who are unwilling or unable to meet performance expectations. It is important that employers are prepared to respond quickly with disciplinary actions, and to appropriately and effectively terminate an employee. If thoughtfully planned and appropriately managed human resource systems are in place to address these circumstances, optimal outcomes can be achieved for all parties. This seminar will discuss the essential elements of an effective discipline system, including due process, grievance and complaint processes, employment-at-will, progressive discipline and positive discipline, wrongful termination, and best practice termination processes. This class is a good follow-up to EXSP 8322 Employee Rights Protection. Upon completion of this seminar, students will be able to: - Define employment-at-will and wrongful discharge. - Describe the HR systems that must be in place to support effective discipline and termination actions. - Identify the characteristics of problem employee behavior and employer responsibilities for responding to these problems. - Describe the difference between traditional discipline and progressive discipline systems. - Describe the elements of an effective discipline climate. - Carry out an effective discipline investigation and interview. - Identify reasons to support employee termination. - Describe the steps in a disciplinary discharge. - Define the Just Cause guidelines for employment termination.
